They have authorization under the California Vehicle Code. They don't take everyone's vehicle, just those being operated by unlicensed drivers. Typically, this is done at the officer's discretion (I only did it when the driver was arrested or a jerk). The "tow them all and let God sort them out" was apparently part of the checkpoint policy--until this change.

The money, you're not going to believe this, all goes to the tow company. Every last cent. So, the cops just get the paperwork. The city gets nothing--unless the vehicle goes to auction.

(by the way, how easy is it to tell if someone is an illegal immigrant anyway? Do they have tattoos?)

Easier than you might think. First, they rarely speak English. Second, they generally tell the truth about where they're from (El Salvador, Guatamala, Michoacan, etc.). Third, they are usually very, very short--a combination of genetics and poor nutrition.

It's really not rocket science.
