Give Congress time to respond or a default position of consent is assumed. I expect it would be challenged but there is a logic there.

Very interesting, but would not pass constitutional muster.

This is like when President Obama tried to tell the Senate it was in recess when it said it was in session. I believe he lost that 9-0 in the Supreme Court. The Senate sets its own rules. The President has no say.
